Returns and Refunds

General policy

Québec consumer law (Loi sur la protection du consommateur, LPC) does not provide a general right of withdrawal for in-person or online purchases of goods in the way European directives do. Sales of unique original artworks are considered final once payment is confirmed and the work has left the studio.

ÜGLY Sculptures does not accept returns based on a change of preference or mind. Each work is unique, non-reproducible, and removed from sale upon acquisition. The specific situations below describe the limited circumstances in which a refund may be issued.

Cancellation before shipment

If a buyer requests cancellation before the work has been handed to a carrier, ÜGLY Sculptures will consider the request. Cancellations in this window are not guaranteed but will be assessed in good faith.

An approved pre-shipment cancellation results in a full refund processed via Stripe within 5 to 10 business days, less any Stripe processing fees that cannot be recovered. The studio will confirm cancellation by email before initiating any refund.

Transport damage

If a work arrives visibly damaged, the buyer must: (1) refuse delivery or note the damage with the carrier at the time of delivery; (2) photograph the packaging and the work in its damaged state; (3) notify ÜGLY Sculptures at studio@uglysculptures.com within 48 hours of receipt.

Failure to document damage at delivery or to notify within 48 hours may limit recourse against the carrier and against ÜGLY Sculptures. Verified carrier damage is handled through a claim process; the studio will coordinate and advise on the appropriate remedy, which may include partial or full refund or replacement where feasible.

Work not as described

If the work received differs materially from its catalogue description in a way that constitutes a defect in the object itself (not a difference in photographic colour rendering or subjective perception), the buyer must notify the studio within 7 days of receipt with photographic evidence.

ÜGLY Sculptures will assess the claim and, if validated, offer a remedy at its discretion: a partial refund or a full refund upon return of the work in its original condition. Return shipping costs are at the buyer's expense unless the defect is attributable to the studio.

Refund timeline

All approved refunds are processed via the original Stripe payment method. Stripe's standard timeline is 5 to 10 business days from the date of approval; actual posting depends on the card issuer.

ÜGLY Sculptures will provide written confirmation when a refund is initiated. If the refund does not appear within 15 business days of that confirmation, contact us.

Consumer rights (LPC)

Nothing in this policy limits the rights of Québec consumers under the Loi sur la protection du consommateur (RLRQ, c. P-40.1) where those rights apply to the transaction. Buyers with questions about their statutory rights may consult the Office de la protection du consommateur (opc.gouv.qc.ca).
